A San Francisco Superior Court judge has passed a preliminary injunction to allow Californian card room operators to continue to operate blackjack whilst a legal challenge can be mounted by the California Gaming Association.
The California Gaming Association had slammed the new regulation put forward by California Attorney General Rob Bonta as an ‘unprecedented power grab’ saying it would damage not only the card rooms sector but also the cities which host them.
San Francisco Superior Court Judge Richard Darwin said that the California Department of Justice’s gambling regulators overstepped their remit by formulating regulations that acted as a statewide ban on some of the cardrooms’ most popular table games, causing significant damage to cardrooms and the communities that rely on them.
The judge said there was clear and convincing evidence that enforcing the new rules would irreparably damage cardrooms and their communities.
Kyle Kirkland, President of the California Gaming Association, said: “Today’s ruling validates what we have said all along: Attorney General Bonta and the Bureau of Gambling Control exceeded their authority by attempting to rewrite California gaming law. These regulations were driven by pressure from powerful tribal gaming interests that have long sought to eliminate lawful competition from California’s cardrooms.”
