A new lawsuit against game developer Evolution alleges the company had a hidden policy to only employ young, attractive white females. After raising concerns about discrimination, employee Marlio Escobar says he was harassed before being unlawfully sacked.

Evolution hired Escobar as a Talent Acquisition Manager in Philadelphia in 2021. In the lawsuit against the company, he claims he became aware of discrimination in February 2023.

He says that supervisors were rejecting viable candidates “on the basis of their age, race, ethnicity, and sexual orientation.”

His supervisor then “strongly suggested” that Escobar’s team look for “young, attractive, white female applicants with no children, and particularly college students.”

Video Recordings Show Discrimination Was Rife

Escobar complained to the company’s HR director in March 2023. He provided “extensive evidence, including several hundred video-recorded interviews and auditions that clearly demonstrate the unlawful rejection of qualified candidates based on their race, gender, age, and other protected characteristics,” according to the complaint.

The lawsuit alleges that Evolution rejected hundreds of qualified candidates for employment on discriminatory grounds. After raising concerns to management, Escobar says his supervisors doubled down on instructions to “weed out
those applicants who did not meet their preferred profile of young, white females.”

Around the same time, the investigative firm BlackCube was also recording Evolution management, alleging that executives were knowingly providing the company’s services to illegal markets.

Whistle Blower Harassed Then Dismissed

Escobar says after reporting the discriminatory hiring policy, he then “experienced harassment, including verbal abuse, and the creation of a hostile work environment.”

Evolution eventually terminated his employment in May 2023 for alleged poor performance. Escobar, however, claims that during his time at the company, he never received any warnings or disciplinary action for poor performance.

He filed a Charge of Discrimination against Evolution with the U.S. Equal Employment Opportunity Agency and the Pennsylvania Human Relations Commission in July 2023. In May this year, he received his Notice of Right to Sue Letter.

The lawsuit, filed in the Eastern District of Pennsylvania, seeks compensation for Escobar’s lost pay, as well as “the pain, emotional distress, embarrassment, humiliation, and damage to his reputation” caused by Evolution’s discriminatory practices.

Other Lawsuits Allege Discrimination

Another lawsuit filed earlier this year in Pennsylvania alleged that the Mount Airy Casino Resort racially discriminated against employees.

Only on that occasion, former employee Adam Stoerrle claims he was “repeatedly demeaned for being white” and told he was “not man enough.” Like Escobar, Stoerrle says he was harassed and had his employment terminated after reporting the discrimination.

A lawsuit brought against Caesars Palace in April, meanwhile, claims the company terminated the employment of African-American Felton Davis based on his race.
