Normative Ordinance No. 1,902, released on Friday, December 6, has implemented a series of restrictions that were initially outlined in July under Normative Ordinance No. 1,231. These restrictions specifically address how betting operators are permitted to advertise within Brazil.
Following a hearing over two days in November at Brazil’s Federal Supreme Court (STF), the implications of betting on the Brazilian population were discussed, leading to a preliminary decision to restrict advertising aimed at minors.
The release of Normative Ordinance No. 1,902 signifies that some sections of Normative Ordinance No. 1,231 are now active. Any additional measures outlined in the ordinance are set to be enforced starting January 1, 2025, coinciding with the official launch of the legal betting market in Brazil.
### What measures are currently in place in Brazil?
The ordinance has immediately enacted four parts of Article 12 from Normative Ordinance 1,231. This includes a ban on advertisements targeting children or teens and ads on channels predominantly viewed by those under 18. Additionally, promotional content utilizing imagery of children or elements especially enticing to minors is prohibited. Gambling activities cannot be linked with cultural events aimed at adolescents in Brazil.
Furthermore, Item I of Article 13 is now effective, obliging all communications from operators to prominently display age restrictions with the ’18+’ symbol or a message indicating “prohibited for people under 18.”
Brazil has also put into effect the second part of Article 17, which prevents operators from sponsoring youth-focused teams or events predominantly attended by adolescents.
To ensure these regulations are adhered to, the rules regarding oversight, monitoring, and enforcement will be enacted immediately by the SPA. However, for other advertising restrictions, operators will be subjected to scrutiny starting January 1.
