Here, the series continues with Peru, with commentary from 4H partner and head of consulting department, Ivan Kurochkin.

Market overview

Peru has emerged as one of Latam’s most engaged gambling markets, with both land-based and online gambling deeply integrated into everyday life. This widespread acceptance has laid the groundwork for rapid development and positioned the country as a key area of opportunity for the igaming industry.

Until recently, online gambling in Peru operated in a legal grey zone – neither formally regulated nor outright banned. That changed with the enactment of Law No. 31557 in 2022, which was fully implemented in 2024. The new regulatory framework introduced mandatory licensing for all operators and imposed a 12% GGR tax, aiming to enhance consumer protection, improve transparency and generate tax revenues for public programs such as tourism and mental health.

With these reforms, Peru now stands out as one of the few fully regulated online gambling markets in Latam, attracting strong interest from both local and international stakeholders. As of 2024, the country reported a GGR of approximately $1.16bn, with a total GDP of $289.2bn and a population exceeding 34 million. Around five million active players, more than 20% of the adult population, reflect a highly engaged user base, reinforcing Peru’s position as a regional hub for igaming expansion.

Regulations

Peru regulates all types of gambling verticals by issuing following types of licences:

  • Online gambling and sports betting.
  • Land-based casinos (including slot machines).
  • Racing (only for non-profit civil association).
  • Lotteries (only for non-profit civil association).
  • B2B (for manufacturers and suppliers).

Licence requirements

  • Gambling activities in Peru may be carried out only by legal entities incorporated under Peruvian law or foreign entities complying with local registration and representation rules.
  • Operators must obtain the relevant licence from the relevant authority (MINCETUR for online casino and sports betting or DGJCMT for casinos and B2B).
  • Full disclosure of ownership and control structure is required, including shareholders holding 10% or more, directors, managers and authorised representatives.
  • Key persons (directors, shareholders, managers) must demonstrate financial solvency and reputational integrity, supported by sworn statements, asset declarations and supporting financial or compliance documentation.
  • Applicants must confirm the absence of legal impediments, disqualifications or administrative sanctions under Peruvian law.
  • All documentation must be submitted in Spanish, with certified translations for foreign-language documents.
  • Authorisations and licences are non-transferable and may not be sublicensed.
  • Participation by unregistered players or inactive accounts is prohibited, including for promotional or free-play purposes.
  • Use of unregistered or unapproved service providers is not permitted.
  • Transactions in cryptocurrencies are prohibited.
  • Operators may not accept advertising from unauthorised or unregistered entities.

Online gambling requirements:

  • Each platform must have a unique registration code issued by MINCETUR.
  • Operators must disclose all service providers connected to the platform, confirming that each holds a valid MINCETUR registration code and clearly defining the services provided.
  • A complete inventory of certified gaming content and equipment must be submitted, including game software, live casino formats, betting modalities, progressive systems and betting terminals, where applicable.
  • Platform change management procedures must be documented and aligned with approved technical standards governing software updates and system modifications.
  • Only approved and registered games, systems, platforms and terminals may be operated.

Land-based gambling requirements:

  • Gambling rooms must comply with statutory minimum distance requirements from places of worship and education institutions. Distance is measured along the shortest pedestrian route between entrances, following actual walking paths and applicable traffic regulations.
  • Operators may not offer prohibited content, including animal fights or races, illegal or rights-infringing games, or bets based on prohibited events.
  • Operators must disclose ownership, manufacturing details, characteristics and registration data for all gaming tables, slot machines, gaming programs and casino game models.
  • Proof of registration with the Peruvian tax authority (SUNAT) and a valid municipal licence is required.

B2B requirements:

  • Manufacturers and suppliers of gaming machines, platforms and related equipment must register with the DGJCMT.
  • Suppliers shall be incorporated in Peru, and if a foreign supplier seeks to offer their services in Peru, they must have branches established in Peru.
  • Servers can be located within or outside Peru and must be installed in settings with air conditioning, protection against fires, installed underground, with uninterrupted access to electricity and with uninterrupted accessibility.

Licence cost and term

Online gambling and sports betting – six years: The annual cost shall be greater of either 3% of the operators’ prior-year NGR or $980,000.

Land-based casino license – from three to 10 years: Casino licensees shall provide the guarantee in the following amounts:

  • Casinos installed in a five-star hotel or a five-star restaurant $820,000.
  • Casinos installed in a four-star hotel $650,000.
  • Casinos installed in a three-star hotel $500,000.
  • $1,600 per slots machine.

B2B registration – two years: The registration is free of charge.

Taxation

Gambling taxation:

  • 12% GGR for all verticals.
  • 1% consumption tax for online gambling and sports betting.
  • $2,400 per slot machine, if monthly income per machine is up to $1,600.
  • $12,200 per slot machine, if monthly income per machine is up to $5,000.
  • $44,200 per slot machine, if monthly income per machine is more than $5,000.
  • $19,600 per casino gambling table, if monthly income per table is up to $6,500.
  • $52,400 per casino gambling table, if monthly income per table is up to $16,300.

General taxation:

  • 29.5% corporate income tax.
  • 18% VAT.
  • 5%-30% withholding taxes.

Responsible gambling and AML

RG requirements:

  • Participation in gambling is prohibited for individuals listed in the national self-exclusion register.
  • Operators must check this register and block access for excluded players, while ensuring full confidentiality of personal data.
  • Players can self-exclude for at least six months or indefinitely. Family members or doctors may also request exclusion.
  • Operators must display a visible link to the MINCETUR portal for self-exclusion registration on the homepage.
  • Once excluded, operators must immediately block all wagers and deposits, allow balance withdrawals unless restricted by law and avoid any marketing or promotional communication to excluded players.
  • Platforms must offer self-control tools such as deposit and bet limits, and self-exclusion options.
  • Operators are required to monitor gambling behaviour and interact with players showing signs of harm.
  • Frontline staff must be trained to understand and respond to gambling problems.
  • The phrase Excessive gambling may cause compulsive gambling” must be displayed on the homepage and in venues, clearly in all visual, audio or audiovisual advertisements.
  • Operators must provide access to professional guidance and addiction treatment services.

AML requirements:

  • Operators must conduct full customer due diligence, verifying each player’s identity, age, nationality, migration status, source of funds and PEP status.
  • Verification may be done through sworn declarations and must cover all relevant identification documents.
  • Operators must implement a robust AML/CTF program to detect and assess unusual activity, especially in high-risk areas or transaction patterns.
  • A dedicated compliance officer, registered with UIF-Peru, must be appointed to oversee monitoring, internal controls and suspicious activity reporting.
  • Suspicious transactions must be reported to UIF-Peru within the legal deadlines.
  • All player and transaction data must be recorded in an operations register and kept for at least five years.
  • Operators must adopt internal AML/CTF policies, conduct regular staff training, maintain updated AML manuals and codes of conduct.
  • Both internal and external AML audits are required, along with annual compliance reports submitted to UIF-Peru.
  • Operators must cooperate with any information requests from UIF-Peru or other competent authorities.

Marketing

Gambling advertising in Peru must include a responsible gambling message warning that excessive gambling may lead to compulsive behaviour. This warning must be prominently displayed in all advertising formats: on websites, it should appear on the homepage in a clearly legible and proportionate manner; in visual and audiovisual ads, the message must be easy to read and appropriately sized; and in radio ads, it must be clearly spoken and understandable. Inside gambling venues, the same warning must be posted in a visible location, following the official size and visibility standards set by regulation.

Additionally, advertising must not target minors or feature them in any form. It is also strictly prohibited to promote any gambling operators that are not officially authorized by MINCETUR to operate in Peru.

Sponsorships related to online gambling and sports betting are allowed only if the sponsoring operator holds a valid licence. Those accepting such sponsorships are responsible for verifying that the sponsor is duly licensed to operate games of chance in the country.

Market specifics for entry

The Peruvian gambling market is one of the largest and most competitive in Latam, with a broad licensed ecosystem spanning online, land-based and B2B segments. Peru has licensed 91 online gambling operators, alongside 69 land-based casinos and 64 B2B providers, although licensing data does not clearly distinguish sports betting from other verticals.

One of the big market challenges is the fragmented regulatory framework. Gambling regulation is spread across multiple, sometimes outdated, legal acts, with separate acts and various sub-laws for online gambling, slots, land-based operations, technical standards and responsible gambling. Despite ongoing regulatory updates, this fragmentation increases compliance complexity and requires careful regulatory navigation by operators.

Overall, despite such complexity, the market remains open to new operators, with licensing still available and no formal restrictions on market entry for foreign companies.

The 4H view

The Peruvian gambling market is shaped by a young, mobile-first audience and a rapidly expanding online segment. The core player demographic is aged 25 to 40, predominantly male, with strong interest in sports betting, especially football. Gambling participation is relatively high, with around 20% of adults engaging in betting activities, and online players showing solid engagement levels by regional standards.

Sports betting is the dominant online vertical, driven by football culture, while online casino (primarily slots and live casino) is growing steadily. Traditional products such as lottery, bingo and land-based slot halls remain relevant but continue to lose share to digital channels. Esports betting is emerging as a small but growing niche among younger players.

Peru’s igaming market reflects a strong commitment to regulation and innovation. Recent legislation covers both traditional and online gambling sectors, which are steadily maturing, setting a foundation for continued growth.
