Payment provider condemns lawsuit filed by Chile’s National Lottery

Chilean payment provider ProntoPaga has condemned the recent lawsuit filed by Chile’s National Lottery Polla Chilena against several companies in the sector. The company also urged lawmakers to update its online gambling laws which are currently under review in the senate.

Through a statement sent to local media the company stated: “As ProntoPaga, we are absolutely and unequivocally clear that processing payments for local and foreign businesses is a completely legal activity under Chilean law, and therefore the allegations of supposed criminal offenses associated with our company’s operations are entirely unfounded.”

The company emphasized that “with absolute responsibility, we want to reassure the various stakeholders in the local financial market. Our company has active mechanisms in place to prevent money laundering and other crimes, which completely refute the allegations made in the complaint.”

According to the statement, similar incidents were previously investigated by the Public Prosecutor’s Office and closed without charges being filed.

The payment processor criticized the state-owned company’s strategy, noting that “it is worrying that Polla has not been able to adapt to the technological transformation process that its sector is experiencing and that with this type of action it is trying to maintain a dominant position that threatens the economy and the development of new technologies and businesses.”

The company emphasised that it supports a modern fintech ecosystem, with strong fraud protection and early detection, along with robust AML/CFT processes. All customers go through KYB and enhanced due diligence that align with the world’s highest standards for anti-money laundering.

ProntoPaga also highlighted its history of proactive collaboration with Chilean regulatory authorities in the past and announced that it had initiated legal action to seek legal certainty regarding its operations.

The statement comes after Polla Chilena filed a criminal complaint against online gambling operators for money laundering, criminal association, and illegal gambling operations.

The action was filed with the 4th Guarantee Court of Santiago and has already been declared admissible. In it, the state-owned company targets payment service providers (PSPs) that, it alleges, facilitated the operation of these platforms, which they argue are prohibited in Chile.
