Partouche questions European validity of applying the theory of reversionary property rights to concession contracts
French casino operator Partouche is continuing to fight the municipality of Berck-sur-Mer following a recent ruling by the Douai Court of Appeal (Nord).
Issued on April 2, concerning the dispute between the Partouche Group, the municipality of Berck-sur-Mer (Pas-de-Calais), and the Infiniti Group, the appeal court rejected the claims made by the Parisian operator regarding the building that housed the casino, operated by its subsidiary SAS Jean Metz, for which it holds a title deed. The court overturned the order issued by the Boulogne-sur-Mer Judicial Court (Pas-de-Calais) on January 14. That order prohibited the municipality from “taking actual possession of the building, either personally or through an intermediary, authorized the Partouche Group to use the keys, badges, access codes, security systems, technical documents, and all material elements enabling access to and operation of the building as a casino, and authorized the Partouche Group to allow access to the building to a third party to operate a business other than the casino.”
“The Douai Court of Appeal issued an unfavorable ruling in the appeal against the January 14, 2026, interim order of the Boulogne-sur-Mer Judicial Court (Pas-de-Calais), which prohibited the municipality of Berck-sur-Mer from taking possession of the casino’s operating building,” Fabrice Paire told the Journal des Casinos.
“Although unfavorable, this ruling was issued in summary proceedings and therefore does not address the merits of the real estate claim. It does not rule on the constitutional or European validity of applying the theory of reversionary property rights to concession contracts.
“Furthermore, at this stage, it does not invalidate the proceedings before the Court of Jurisdictional Conflicts, which should provide some answers under domestic law. An appeal has already been filed.”
