The Chamber of Deputies has completed voting on the anti-faction bill, which increases penalties for participation in organized crime or militias and provides for the seizure of the investigated person’s assets in certain circumstances.
According to a Chamber of Deputies press release, the text approved in the Plenary maintains most of the version prepared by the Chamber last year and rejects the majority of the changes made by the Senate. The proposal will be sent to the president for sanction.
The bill’s rapporteur, Guilherme Derrite, defended provisions proposed by the senators, including the creation of a 15% Contribution for Intervention in the Economic Domain (CIDE) tax on bettor deposits to fund the fight against organized crime.
This new tax, however, was removed from the text by a Partido Progressista (Progressive Party) amendment and will move forward in another project.
The amendment also removed provisions to regularize tax debts owed by online gambling companies in the last five years, based on self-declaration to Brazilian Federal Revenue Service, and additional oversight measures by the financial sector.
The National Association of Games and Lotteries (ANJL) expressed its concern over the new tax in December. The organisation, which represents some of the leading operators in Brazil, stated that it was “essential to clarify that the betting operator acts as a custodian of the client’s resources. The money, even after being deposited on the platform, remains the property of the player. Taxing this stage of the operation would be akin to charging a tax for a citizen to deposit their money in a bank account or load a prepaid card—this sets a dangerous precedent with no parallels in the Brazilian tax system.”
