A new provisional measure determines that 3% of the amount collected by betting will be allocated to the Fund for Equipping and Operationalizing the core activities of Brazil’s Federal Police (Funapol). The MP redirects the portion previously destined for health, social assistance and Social Security and does not alter the percentage that remains with the betting houses.
MP 1.348/2026 authorizes the federal government to contribute up to R$ 200 million to Funapol in 2026.
The text provides for a transition period for allocating the new percentage to the fund: 1% of the total amount in 2026, 2% in 2027, and 3% from 2028 onwards. The percentages are applied after the payment of premiums and the deduction of income tax.
The remainder of the funds to which the government is entitled will be distributed among various ministries, non-governmental organizations, and sports entities. Among them are the National Public Security Fund and Social Security, which will receive 1.2% of the amount collected by betting companies.
According to the Senate News Agency, the measure also allows federal police officers, federal highway police officers, and federal prison officers to be compensated for “extraordinary activities,” provided that this is stipulated in future legislation.
The provisional measure specifies that Funapol may be used to reimburse the health expenses of public servants.
The percentage allocated to betting houses remains at 85% of the total amount collected. The funds must be used to cover the operating and maintenance expenses of the fixed-odds betting lottery operator and other betting games.
The National Congress must analyse the provisional measure within a maximum of 120 days. If approved, the rule will be converted into law, making it definitive. The text amends Complementary Law 89 of 1997, which establishes Funapol, and Law 13.756 of 2018 , which allowed fixed-odds betting lotteries and other betting games in Brazil.
