During a Massachusetts Gaming Commission (MGC) meeting on February 12, 2026, regulators opened a formal compliance case against BetMGM for sending promotional emails to individuals under 21.

Senior Enforcement Council Zach Mercer stated the complaint involves BetMGM as a category 3 sports betting licensee and its non-compliance with state sports betting laws. More specifically, the promotions were sent out to players based on their use of Major League Baseball’s Ballpark app at Red Sox games.

Between April 10, 2024, and July 25, 2025, 96,167 emails were sent connected to eight Red Sox games, and BetMGM confirmed to the commission that 3,803 of the emails were sent to under-21s. Additionally, 19 self-excluded individuals and 25 individuals with a cool-off status received the emails.

The ages of 37,632 email recipients couldn’t be verified, according to BetMGM, as the company also stated that the incident was the mistake of one employee who didn’t follow the operator’s internal policies.

MGC Chair Jordan Maynard stressed that the commission’s goal is to reach zero access for under-21s to sports betting in Massachusetts. He also supported the idea of bringing the operator before the full commission for an adjudicatory hearing.
