Kanon Gaming’s duty of care failings penalty reduced to SEK4.8m

Kanon Gaming has had its 2024 fine related to duty of care failings reduced to SEK4.8m (£380,459) after the operator successfully appealed the initial decision made by the Swedish Gambling Authority (SGA).

Kanon Gaming was fined SEK7m in 2024 for duty of care failings towards customers following an investigation conducted the previous year by the SGA.

However, upon Kanon Gaming appealing the regulator’s decision, Sweden’s Administrative Court reduced the fine, while maintaining the stance that the sanction should be high.

The court noted the operator had quickly addressed the issues raised in the investigation and had fully cooperated with the SGA.

The length of time between the investigation and the decision on the initial fine was also taken into account and played a role in the penalty being lowered.

The 2023 investigation found Kanon Gaming had not taken the appropriate measures to help its at-risk customers reduce their gambling activity, even when showing signs of excessive gambling behaviour, and that Kanon Gaming should have had more contact with its customers in order to protect them from gambling-related harm.

Examples found one customer made between 40 to 80 deposits per day, and another player deposited SEK68,720 and lost SEK66,617 during the period the operator was investigated.

Kanon Gaming did not dispute the regulator’s assessment that it had failed in its duty of care towards customers.

The operator since confirmed it had made several changes to its duty of care approach, effective from May 2024.
