Ecuador raises licensing and compliance requirements for sports betting companies

Ecuador has significantly raised the bar for companies seeking to operate in the sportsbetting market, using secondary legislation to tighten both the economic and regulatory conditions for entry.

A new regulation to the Organic Law of Sport, Physical Education and Recreation, issued by President Daniel Noboa during the 2026 World Cup period, defines a licensing model under which operators must secure authorisation from the national sports authority and pay a fee equivalent to 655 basic annual salaries for each year of validity, around USD 315,000 in 2026.

Licences may be renewed once for a further five years, subject to continued compliance and payment of the applicable fee.

The regulation establishes a broad set of legal and financial requirements aimed at ensuring that operators are locally anchored and fiscally sound. Applicants must submit a formal request to the head of the sports authority, provide documentation evidencing their legal personality and purpose, and demonstrate domicile and residence in Ecuador.

They must also show that they are up to date with their obligations to the national tax administration and social‑security system, present audited financial statements for the previous fiscal year and comply with minimum capital or equity indicators commensurate with the projected scale of their operations. For foreign‑owned entities, the rule requires evidence of proper incorporation and authorisation to operate in the country.

On the technical side, the regulation obliges operators to prove ownership or exclusive rights over the domain names and distinctive signs under which they will offer their services, and to provide a technical certification of their digital platforms from a laboratory authorised by the sports authority.

This is coupled with operational requirements that include a responsible‑gambling manual, procedures to verify the identity and age of users and mechanisms to ensure the integrity and traceability of transactions.

The package aligns Ecuador with a broader regional tendency to formalise sports betting through high entry fees and detailed compliance obligations, with the dual aim of raising revenue and exerting tighter control over the sector’s participants.

On December 19 2025, the National Assembly approved by 84 votes to 60 the new Organic Law on Sport, Physical Education and Recreation that replaced the framework in force since 2010 and, for the first time, embedded the regulation of sports betting in the country’s sports law itself. The text, returned with executive observations from Noboa and reapproved by 86 votes on February 10 2026.
