Court in Chile closes case on blocking betting sites, saying tech block not mandatory

The Court of Appeals of Santiago has ordered the closure and dismissal of the dispute between Lotería de Concepción and the telecommunications companies Claro, Entel, GTD, Movistar, WOM, and VTR regarding the blocking of illegal online betting sites in Chile.

The decision was made after the court considered that the request by the gambling authority—which sought that ISPs implement more sophisticated technologies to block these platforms—exceeded current regulations.

In 2024, Lotería de Concepción turned to the courts to demand the blocking of illegal betting sites. Although the action was initially rejected, in September 2025 the Supreme Court ruled in its favour.

Subsequently, the entity attempted to expand the scope of the measure, requesting the inclusion of technology to prevent the appearance of “mirror sites.”

To resolve the matter, the Court considered a formal opinion from the Undersecretariat of Telecommunications, which noted that there are no norms yet obligating companies to apply this type of technology.

As a result, the court concluded that the initial order had already been fulfilled, but that “a different matter is the active and intrusive blocking by the concessionaires or ISPs, of a permanent nature, that imposes more sophisticated and invasive technological standards, not required by our regulations.”

The announcement is the latest development in a long running saga between state monopoly holders and online operators who have now been battling it out in the courts for years.

This battle arguably took its most dramatic turn in February when the Chilean National Lottery Polla Chilena de Beneficencia filed a criminal complaint against online gambling operators for money laundering, criminal association, and illegal gambling operations.

The action was filed with the 4th Guarantee Court of Santiago and has already been declared admissible. In it, the state-owned company targets payment service providers (PSPs) that, it alleges, facilitated the operation of these platforms, which are prohibited in Chile.
