City of Bodó suspends lottery amidst growing controversy

The mayor of the city of Bodó  Horison José da Silva has suspended all municipal lottery activities in the city including Lotseridó, which had been operating since July 2024. The measure was published in the Official Gazette on Monday, the 27th, and aims to prevent “the continuation of possible irregularities and safeguard the public interest.”

This decision comes amid questions about the legality of the service, which can only be exploited by the Union, states, and the Federal District, according to federal law 14.790 of 2023.

Bodó which is located in the state of Rio Grande do Norte had 53 authorized betting sites approved by the city hall, with revenue equivalent to 22% of the 2024 budget – and authorized 32 companies to operate online betting. Some companies managed up to three sites, totalling 53 platforms.

Between November 2024 and August 2025, the city hall collected R$ 8 million from grant fees of R$ 5,000 per company and a monthly transfer of 2% of gross revenue.

The Secretary of Finance of Bodó, Rômulo Farias, stated, “I consider it to be legal because the municipality has its competencies. We can legislate on matters that a federal law does not prevent.” He also noted that the revenue was generated because the companies offered their services throughout Brazil.

Companies approved by the federal government must pay a grant of R$ 30 million, whereas in Bodó, the fee was R$ 5,000, equivalent to 0.01% of the federal amount.

The Ministry of Finance, through the Secretariat of Prizes and Bets (SPA), informed local media outlet  g1 that “it treats sites with municipal authorizations the same way it treats illegal sites,” requesting blocking through Anatel.

The case remains unresolved, pending a final decision from the Supreme Federal Court (STF). In February the Ministry of Finance notified the municipality of Bodó, to suspend the licensing process for online gambling companies. Bodó has a population of just over 2,000 inhabitants.
