Chile’s Supreme Court accepted a protection request filed by the Lotería de Concepción. The Court ordered the major telecommunications companies— Claro, Entel, GTD, Movistar, WOM, and VTR —to immediately block all online gambling websites requested by the appellant.
The Court described the telecommunications companies’ conduct as “illegal and arbitrary” for allowing the promotion and transmission of a prohibited activity. The appeal was based on the infringement of the property rights of the Concepción Lottery.
“The appeal for protection is granted… and it is established that the respondents may not broadcast or promote gambling unless they provide legal authorization and authorization from the administrative authority. Therefore, they must immediately block all websites requested by the appellant in these proceedings,” the Court ruled.
The same document adds that only the Lotería de Concepción, Polla Chilena de Beneficencia, the state-owned gaming and lottery operator, and Teletrak, which offers live broadcasts on horse race in betting shops throughout Chile, are legally authorized to carry out certain games.
The Association of Online Betting Platforms (Apal) addressed the ruling of the Supreme Court arguing that it was high time that the industry was regulated.
“We regret that the Supreme Court, in a divided ruling, has reversed the decision of the Santiago Court of Appeals—which in April rejected a protection resource presented by the Lottery of Concepción—on the grounds that online betting would be ‘proscribed’ in our legislation, a claim that lacks normative support,” Apal argued.
The association continued by stating that the responsibility lies with Congress. “Chile urgently needs modern regulation, similar to what exists in more than 70% of OECD countries . . . Our position has been clear and consistent: we want this activity to be regulated in Chile. The companies that are part of this association already operate under stringent regulatory frameworks in other countries, with policies for the protection of minors, safeguarding personal data, and prevention of money laundering. In Chile, we have actively promoted regulatory processes and will continue to advocate for the need for modern, sustainable, and balanced legislation,” it concluded.
