Buenos Aires province approves law barring individuals with child support debts from gambling venues

The Senate of the province of Buenos Aires has approved a law initiated by Germán Di Césare, a deputy from Unión por la Patria, that prohibits individuals with child support debts from entering casinos, gaming halls, and bingo establishments throughout the province.

The Buenos Aires government will implement a new control mechanism to ensure compliance with child support obligations, in alignment with the tools already established by the judiciary. The law authorizes the Executive to “implement the necessary procedures” for gaming establishments to identify individuals who fall under this restriction.

The project was developed with the aim of enabling the provincial government to adopt concrete measures to restrict access in order to promote the fulfilment of financial obligations related to the maintenance of children.

The proposal approved by the provincial legislature applies to those listed in the RDAM (Register of Debtors for Child Support) for owing three consecutive payments or five alternate payments, a criterion already established by the Buenos Aires judiciary to determine child support delinquency.

However, the law requires that the staff of casinos, gaming halls, and bingo operations be responsible for preventing access to these individuals, and that the Executive supervise the proper enforcement of the regulations, creating a shared responsibility framework between gambling establishments and the provincial authorities.

In his arguments for the project, Di Césare pointed out that it is supported by the Convention on the Rights of the Child, which states that governments “must ensure adequate conditions for the physical, mental, spiritual, moral, and social development of children,” and that individuals responsible for their maintenance must provide the necessary resources within their means.

Di Césare’s initiative emphasises the fact that gambling activities pose risks to personal and family finances. Enforcement will fall under the jurisdiction of the provincial Executive, which must coordinate with casino and gaming hall operators to ensure compliance.
