Ministry enacts new ad regulations as lawmakers call for gambling bill in Argentina

The national government is moving forward with new measures to regulate the advertising of online games and betting.

Through Resolution (SIyC) 446/2025, published on November 3 in the Official Gazette, a new regime has been approved that establishes mandatory warnings, controls over influencers, and penalties for non-compliance, all within the framework of the Consumer Protection Law and the Commercial Loyalty regulations.

According to the new regulations, all advertising for online games and betting must clearly and prominently include the warnings: “+18” and “Gambling Compulsively is Detrimental to Health.”

An official channel is also being created to report influencers or individuals who promote online betting sites without including the mandatory legal warnings. The new framework applies to all advertising pieces across various media, including social media platforms and media outlets, public signage, radio and television, as well as print and digital media. The measure will come into effect 30 days after its publication, meaning it will be in force from December 3, 2025.

The new rules come as lawmakers are trying to put pressure on the senate to pass a much stricter gambling bill.   

Deputies Maximiliano Ferraro and Mónica Frade have called through social media channels for senators to move forward with the bill which would impose a new national online gambling policy aimed at preventing gambling related harm.

In November the Chamber of Deputies voted with 139 votes in favour of a bill that prohibits advertising, promotion, and sponsorship of online gambling across various platforms, including social media, influencers, sports apparel, billboards on public roads, as well as print, radio, and television media. It would also impose a wide number of other measures aimed at protecting players.

The bill was approved by a majority in the Chamber of Deputies, but still requires discussion, amendments, and approval in the Senate before becoming law. The chair of the Health committee, Lucia Corpacci, has held a number of meetings with specialists. However, progress on the treatment of the project, which was sent to three committees in the Senate, has not advanced any further.
