Aviator LLC has rejected what it calls “misleading” claims by Spribe regarding a UK High Court interim injunction. The Georgian company has stressed that the order is a narrow procedural measure affecting only the UK market, where it has no immediate plans to operate, and does not address copyright or trademark ownership.
The injunction follows Aviator’s legal victory in Georgia, where the Supreme Court confirmed Spribe’s bad-faith trademark registrations and copyright infringement. In the UK proceedings, Spribe sought to restrict Aviator from using its brand or making public ownership claims, but the court rejected these efforts, allowing Aviator to maintain its public position and apply for a UK gambling licence if desired.
Aviator noted that the order carries no commercial impact, as it was granted on the condition that Spribe compensates any damages if wrongly issued, and the trial is expected to conclude before any licence is processed. The company accuses Spribe of “spin” and has vowed to continue defending its intellectual property.
Aviator continues to be engaged in a multi-jurisdiction dispute with Estonia’s SPRIBE OU, which it accuses of bad faith trademark registration and copyright infringement. Georgian courts have already invalidated SPRIBE’s trademarks in all three judicial instances, with final judgment in Aviator’s favour.
At the European Union Intellectual Property Office (EUIPO), SPRIBE failed to file a defence against Aviator’s invalidation claim, increasing Aviator’s confidence in a favourable ruling. In the UK, Aviator is seeking to invalidate SPRIBE’s trademarks and claims global copyright infringement. SPRIBE has counterclaimed for “passing off” and so secured the partial injunction preventing Aviator from offering or promoting its game in the UK until trial. Aviator plans to appeal.
Aviator LLC continues to pursue trademark invalidations against SPRIBE in multiple jurisdictions, including the EU and UK, while maintaining international registrations of the Aviator mark.
