Argentina’s online gambling bill postponed until next year

The initiative to regulate online gambling and set limits on advertising has come to a halt in the Senate and will not be revisited until 2026. Although it received initial approval from the House of Representatives, disagreements within committees have prevented any significant progress on the proposal. This year, the Health Commission, led by Senator Lucía Corpacci, was the sole body to examine the issue but it failed to produce a report.

The delay has also been attributed to a change in the analysis process, as the issue was subsequently assigned to the General Legislation and Justice and Penal Affairs committees. This shift, which took place after several months, hindered the possibility of convening a plenary meeting to advance the proposal toward a vote.

The proposed legislation, if approved by the Senate, would ban advertising, promotion, and sponsorship of online gambling across all media platforms, including social media and sporting events. It would also prohibit welcome bonuses, mandate biometric verification for user identity and age confirmation, and impose several other restrictive measures on online gaming operators.

However the bill has been plagued by a number of problems with opponents arguing that it is overly restrictive and it infringes upon the rights reserved to provincial governments. After it was approved in the House of Representatives and sent to the Senate it was revealed that the government of Javier Milei planned to issue a Decree of Necessity and Urgency (DNU) specifically aimed at combating child gambling addiction, with the intention of blocking the project in 2025. Furthermore, it was confirmed that Milei would veto the law should it gain Senate approval. In addition according to local press Milei’s administration is preparing a less restrictive bill that will be aimed solely at preventing gambling addiction.
