Brazilian government opens B2B licensing consultation window

The Brazilian government has opened a public consultation over legislation regarding a licensing structure for B2B suppliers in the country. 

The Ministry of Finance’s Prizes and Betting Secretariat (SPA), which oversees the market, submitted draft legislation which would obligate suppliers to obtain a licence within six months of entering Brazil.  

Although the consultation was originally scheduled for Q3 2025, the window will now remain open until 23 March 2026.  

Should the legislation come into force, affected suppliers will include those that provide betting systems or platforms as well as any online gaming providers. 

Suppliers offering customer identification services or sports betting data will also be subject to the new laws. 

Any overseas B2B providers without a local presence in Brazil will be free to apply for a licence provided they establish a Brazilian subsidiary within 120 days.  

Agreements between suppliers and operators must be drafted in Brazilian Portuguese.

Licensed operators will need to terminate agreements with B2B providers that fail to obtain their licence. 

The move would represent a step forward taken by the operator in its fight against the black market, as only licensed suppliers would be able to offer gaming services in Latam country. 

Brazil’s regulated gaming market has been in operation for just over a year, having first gone live on 1 January 2025.  

The government collected BRL10bn (£1.4bn) in tax revenue from operators during that year, according to figures released by the Brazilian Federal Revenue Service. 

A new 15% tax on player deposits for operators has also been approved, with an increase of gross gambling revenue (GGR) tax from 12% to 15% over the next three year being tabled. 

Data released by the SPA also showed operators are expected to generate GGR of BRL37bn for 2025.
